環保部:全面放開服務性環境監測市場

2月10日(ri),環保(bao)部(bu)網站發布(bu)《關于推進環境監測服(fu)務社會化的指導(dao)意見》。意見提(ti)出,全面(mian)放開(kai)服(fu)務性監測市場,有序放開(kai)公(gong)益(yi)性、監督性監測領(ling)域。

關于推進環境監測服務社會化的指導意見

  各省、自治(zhi)區、直(zhi)轄市環(huan)境(jing)保(bao)護(hu)廳(局(ju)),新(xin)疆生產(chan)建(jian)設兵團環(huan)境(jing)保(bao)護(hu)局(ju),解放軍環(huan)境(jing)保(bao)護(hu)局(ju),遼(liao)河保(bao)護(hu)區管理局(ju):

  為(wei)全面深化(hua)生態(tai)文明體制改(gai)革,根據《環境保(bao)護(hu)法》和國務院辦公廳(ting)《關(guan)于政(zheng)府向社(she)會力量購買服務的指(zhi)導意見》(國辦發〔2013〕96號)精(jing)神(shen),引(yin)導社(she)會力量廣泛參與環境監測,規(gui)范社(she)會環境監測機構行為(wei),促進環境監測服務社(she)會化(hua)良性發展,現提出以下意見:

  一(yi)、充分認識推進環境監(jian)測服(fu)務(wu)社(she)會(hui)化的重要(yao)意義(yi)

  (一(yi))環(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)(ce)服(fu)(fu)務(wu)社(she)(she)會(hui)化是(shi)環(huan)(huan)(huan)(huan)(huan)(huan)保(bao)(bao)(bao)體(ti)(ti)制(zhi)(zhi)機(ji)(ji)制(zhi)(zhi)改革(ge)創新(xin)的(de)重要內容。長期以來,我國實行的(de)是(shi)由政(zheng)(zheng)(zheng)府(fu)有(you)關部門所屬環(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)(ce)機(ji)(ji)構為主(zhu)開(kai)展(zhan)監(jian)(jian)測(ce)(ce)(ce)活(huo)動的(de)單一(yi)管(guan)理體(ti)(ti)制(zhi)(zhi)。在(zai)環(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)保(bao)(bao)(bao)護(hu)領域日益擴大、環(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)(ce)任務(wu)快速增加和環(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)管(guan)理要求不斷提高的(de)情況下(xia),推進(jin)環(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)(ce)服(fu)(fu)務(wu)社(she)(she)會(hui)化已(yi)(yi)迫在(zai)眉睫。一(yi)些地方已(yi)(yi)經開(kai)展(zhan)了(le)實踐探索,出(chu)臺了(le)相應的(de)管(guan)理辦法,許多社(she)(she)會(hui)環(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)(ce)機(ji)(ji)構已(yi)(yi)經進(jin)入環(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)(ce)服(fu)(fu)務(wu)市場(chang)。環(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)(ce)服(fu)(fu)務(wu)的(de)社(she)(she)會(hui)化既是(shi)加快政(zheng)(zheng)(zheng)府(fu)環(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)保(bao)(bao)(bao)護(hu)職能轉變、提高公共服(fu)(fu)務(wu)質量和效率的(de)必然要求,也是(shi)理順環(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)保(bao)(bao)(bao)護(hu)體(ti)(ti)制(zhi)(zhi)機(ji)(ji)制(zhi)(zhi)、探索環(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)保(bao)(bao)(bao)護(hu)新(xin)路(lu)的(de)現實需要。引導社(she)(she)會(hui)環(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)(ce)機(ji)(ji)構進(jin)入環(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)(ce)的(de)主(zhu)戰場(chang),提升政(zheng)(zheng)(zheng)府(fu)購買社(she)(she)會(hui)環(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)(ce)服(fu)(fu)務(wu)水平,有(you)利于(yu)整合社(she)(she)會(hui)環(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)(ce)資源,激發社(she)(she)會(hui)環(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)(ce)機(ji)(ji)構活(huo)力,形(xing)成環(huan)(huan)(huan)(huan)(huan)(huan)保(bao)(bao)(bao)系(xi)統環(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)(ce)機(ji)(ji)構和社(she)(she)會(hui)環(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)(ce)機(ji)(ji)構共同(tong)發展(zhan)的(de)新(xin)格局(ju)。

  二、指導思想與基(ji)本原(yuan)則

  (二)指導(dao)思想。以(yi)黨的十(shi)八大和十(shi)八屆三中(zhong)、四(si)中(zhong)全會精神為(wei)(wei)指導(dao),強(qiang)(qiang)化政(zheng)府環(huan)(huan)境(jing)監(jian)測(ce)(ce)公(gong)共服務(wu)職(zhi)能,加快(kuai)轉變環(huan)(huan)境(jing)監(jian)測(ce)(ce)職(zhi)能,推進政(zheng)事分開(kai)和政(zheng)社(she)分開(kai),鼓(gu)勵引導(dao)社(she)會環(huan)(huan)境(jing)監(jian)測(ce)(ce)力量(liang)廣泛參與,創(chuang)新(xin)環(huan)(huan)境(jing)監(jian)測(ce)(ce)公(gong)共服務(wu)供給(gei)模(mo)式,強(qiang)(qiang)化環(huan)(huan)境(jing)監(jian)測(ce)(ce)事中(zhong)事后監(jian)管,形成以(yi)環(huan)(huan)保系統環(huan)(huan)境(jing)監(jian)測(ce)(ce)機構(gou)為(wei)(wei)骨干、社(she)會環(huan)(huan)境(jing)監(jian)測(ce)(ce)力量(liang)共同參與的環(huan)(huan)境(jing)監(jian)測(ce)(ce)管理新(xin)體制。

  (三)基本原則

  ——積極引導。堅持從實際出發,放寬準入條(tiao)件,充分發揮政府的主導作(zuo)用和市場在資源配置中(zhong)的決(jue)定性作(zuo)用,激勵社(she)會環境監測機構(gou)提供監測服務供給。

  ——加(jia)快培育。積極培育環境(jing)(jing)監(jian)測服(fu)務(wu)市場,營造(zao)公平競爭的市場環境(jing)(jing),有序放(fang)開環境(jing)(jing)監(jian)測服(fu)務(wu)業務(wu)領域,推動(dong)環境(jing)(jing)監(jian)測服(fu)務(wu)社會化工作穩步開展(zhan)。

  ——規范管(guan)理。建(jian)立完善環境(jing)監測(ce)服(fu)務社(she)會化(hua)管(guan)理規章(zhang)制(zhi)度,約束環境(jing)監測(ce)服(fu)務行(xing)為,促(cu)進社(she)會環境(jing)監測(ce)機構不斷提高(gao)環境(jing)監測(ce)質量和管(guan)理水平(ping)。

  ——依法監(jian)督。強化環(huan)境監(jian)測(ce)(ce)行(xing)為的事中、事后監(jian)管,實(shi)施(shi)對社會環(huan)境監(jian)測(ce)(ce)機構及(ji)其監(jian)測(ce)(ce)服務(wu)行(xing)為的監(jian)督管理(li),建立正常(chang)(chang)的退出機制,維(wei)護環(huan)境監(jian)測(ce)(ce)服務(wu)市場的正常(chang)(chang)秩序。

  三、開(kai)放環(huan)境(jing)監測服務(wu)市場

  (四)全面放開服(fu)務(wu)性監(jian)測(ce)(ce)市場(chang)。凡適合社會(hui)力量承擔的服(fu)務(wu)性環(huan)境(jing)(jing)(jing)(jing)監(jian)測(ce)(ce)業務(wu),要創造條(tiao)件,全面放開。鼓勵社會(hui)環(huan)境(jing)(jing)(jing)(jing)監(jian)測(ce)(ce)機構參與排污(wu)單位污(wu)染源自行監(jian)測(ce)(ce)、環(huan)境(jing)(jing)(jing)(jing)損害評估監(jian)測(ce)(ce)、環(huan)境(jing)(jing)(jing)(jing)影響評價現狀監(jian)測(ce)(ce)、清潔生產(chan)審核、企事(shi)業單位自主調查等環(huan)境(jing)(jing)(jing)(jing)監(jian)測(ce)(ce)活動(dong),推(tui)進環(huan)境(jing)(jing)(jing)(jing)監(jian)測(ce)(ce)服(fu)務(wu)主體多(duo)元化和服(fu)務(wu)方式多(duo)樣化。

  (五(wu))有序(xu)放開公(gong)益性(xing)、監(jian)(jian)(jian)督(du)性(xing)監(jian)(jian)(jian)測(ce)(ce)(ce)領域。各級環(huan)(huan)(huan)境(jing)(jing)保(bao)護行政主(zhu)管(guan)部(bu)(bu)門(men)所屬環(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)機(ji)構(gou)應(ying)認真做好所承擔(dan)的(de)政府(fu)監(jian)(jian)(jian)測(ce)(ce)(ce)職能,包括(kuo)環(huan)(huan)(huan)境(jing)(jing)質(zhi)(zhi)量(liang)監(jian)(jian)(jian)測(ce)(ce)(ce)、預(yu)(yu)報預(yu)(yu)警(jing)、跨境(jing)(jing)水(shui)體(ti)(ti)監(jian)(jian)(jian)測(ce)(ce)(ce)、履約監(jian)(jian)(jian)測(ce)(ce)(ce)、污(wu)染源監(jian)(jian)(jian)督(du)性(xing)監(jian)(jian)(jian)測(ce)(ce)(ce)、突發環(huan)(huan)(huan)境(jing)(jing)事件(jian)應(ying)急監(jian)(jian)(jian)測(ce)(ce)(ce),以及環(huan)(huan)(huan)境(jing)(jing)執法、環(huan)(huan)(huan)境(jing)(jing)質(zhi)(zhi)量(liang)目標責任考核、排污(wu)費征收、總(zong)量(liang)核算等(deng)環(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)(jian)管(guan)中的(de)監(jian)(jian)(jian)測(ce)(ce)(ce)工(gong)作(zuo)。同時,可以根據財政部(bu)(bu)、民政部(bu)(bu)和工(gong)商總(zong)局關(guan)于政府(fu)購買服務(wu)的(de)總(zong)體(ti)(ti)要求,將社(she)會環(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)機(ji)構(gou)能夠承擔(dan),又不影響公(gong)平公(gong)正(zheng)原(yuan)則的(de)相關(guan)業務(wu),積極穩(wen)妥、因地制宜地向社(she)會環(huan)(huan)(huan)境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)機(ji)構(gou)有序(xu)放開,包括(kuo)環(huan)(huan)(huan)境(jing)(jing)質(zhi)(zhi)量(liang)自動(dong)監(jian)(jian)(jian)測(ce)(ce)(ce)站(zhan)和污(wu)染源自動(dong)監(jian)(jian)(jian)測(ce)(ce)(ce)設施的(de)運行維護、固體(ti)(ti)廢物(wu)和危險廢物(wu)鑒別等(deng)監(jian)(jian)(jian)(檢)測(ce)(ce)(ce)業務(wu)。

  四、扶(fu)持和規范社會(hui)環境監(jian)測機構發展

  (六)轉(zhuan)變管(guan)(guan)理方式。凡適合社(she)(she)會力量(liang)承(cheng)擔的(de),環境保護(hu)行(xing)政(zheng)主管(guan)(guan)部門(men)均可依據(ju)本(ben)行(xing)政(zheng)區(qu)實際,選擇采取委托、承(cheng)包、采購、名(ming)錄管(guan)(guan)理等(deng)方式交由社(she)(she)會力量(liang)承(cheng)擔。同(tong)(tong)時,要加(jia)強對社(she)(she)會環境監(jian)測機構事中和事后(hou)監(jian)管(guan)(guan),會同(tong)(tong)相(xiang)關部門(men)共同(tong)(tong)出臺(tai)相(xiang)關管(guan)(guan)理政(zheng)策(ce)和辦法(fa),推動環境監(jian)測服務(wu)社(she)(she)會化(hua)工作(zuo)的(de)制度化(hua)、體系化(hua)、規范化(hua)。

  (七)扶持(chi)行(xing)(xing)業(ye)(ye)發(fa)展(zhan)。要充分發(fa)揮(hui)環(huan)境(jing)監(jian)(jian)(jian)測(ce)行(xing)(xing)業(ye)(ye)協會或第三方機構(gou)的作(zuo)用,強化(hua)社(she)會環(huan)境(jing)監(jian)(jian)(jian)測(ce)機構(gou)的行(xing)(xing)業(ye)(ye)管理,簽訂質量保證承(cheng)諾(nuo),推動行(xing)(xing)業(ye)(ye)自律。組織(zhi)開展(zhan)社(she)會環(huan)境(jing)監(jian)(jian)(jian)測(ce)技術人(ren)員業(ye)(ye)務(wu)(wu)培訓、業(ye)(ye)務(wu)(wu)比武,評估社(she)會環(huan)境(jing)監(jian)(jian)(jian)測(ce)機構(gou)的業(ye)(ye)務(wu)(wu)水(shui)平(ping),促(cu)進環(huan)境(jing)監(jian)(jian)(jian)測(ce)服務(wu)(wu)行(xing)(xing)業(ye)(ye)水(shui)平(ping)的不斷提升。

  (八)加強誠(cheng)信建(jian)設。社會環境(jing)監(jian)測機構(gou)應(ying)對所提供監(jian)測數據的(de)(de)真實(shi)性和(he)(he)準確性負責,建(jian)立健全(quan)質量保證和(he)(he)質量控制體系,嚴格執行國家和(he)(he)地方的(de)(de)法律(lv)法規、標準和(he)(he)技(ji)(ji)術(shu)規范,規范環境(jing)監(jian)測行為。加強技(ji)(ji)術(shu)人員(yuan)培訓,鼓勵監(jian)測技(ji)(ji)術(shu)人員(yuan)積極參(can)加省(sheng)級及以(yi)上(shang)環境(jing)保護行政主管部(bu)(bu)門(men)認可的(de)(de)業務培訓。主動公開(kai)信息,自覺接受社會公眾和(he)(he)環保部(bu)(bu)門(men)監(jian)督,提高誠(cheng)信意識和(he)(he)服務水(shui)平。

  五、依法監(jian)督環(huan)境監(jian)測服務行為

  (九)完善(shan)(shan)監(jian)(jian)(jian)(jian)(jian)管(guan)機(ji)制。省(sheng)級環(huan)境(jing)保護(hu)行(xing)政(zheng)(zheng)主管(guan)部門(men)應完善(shan)(shan)日常監(jian)(jian)(jian)(jian)(jian)督(du)檢(jian)查機(ji)制,加強(qiang)過程(cheng)監(jian)(jian)(jian)(jian)(jian)管(guan)和信息(xi)公(gong)(gong)(gong)開,定期(qi)和不定期(qi)地檢(jian)查社(she)(she)會(hui)(hui)環(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)機(ji)構的監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)質量,公(gong)(gong)(gong)布(bu)(bu)社(she)(she)會(hui)(hui)環(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)機(ji)構概況和環(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)服(fu)務(wu)(wu)行(xing)為監(jian)(jian)(jian)(jian)(jian)督(du)檢(jian)查結(jie)果,建立(li)公(gong)(gong)(gong)示(shi)制度(du)和退出機(ji)制。完善(shan)(shan)社(she)(she)會(hui)(hui)環(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)服(fu)務(wu)(wu)機(ji)構信用記(ji)錄(lu),社(she)(she)會(hui)(hui)環(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)機(ji)構及(ji)其法(fa)(fa)定代表(biao)人在(zai)環(huan)境(jing)監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)服(fu)務(wu)(wu)活動中存在(zai)不規范監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)行(xing)為的,環(huan)境(jing)保護(hu)行(xing)政(zheng)(zheng)主管(guan)部門(men)應將相應機(ji)構、法(fa)(fa)人、監(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)技術人員的違(wei)法(fa)(fa)信息(xi)記(ji)入社(she)(she)會(hui)(hui)誠(cheng)信檔(dang)案,并(bing)及(ji)時(shi)向社(she)(she)會(hui)(hui)公(gong)(gong)(gong)布(bu)(bu)。

  (十)強化(hua)責任追(zhui)究。社會環境(jing)監測(ce)機構(gou)(gou)在(zai)有(you)關環境(jing)服(fu)務(wu)活動(dong)中弄(nong)虛作(zuo)假(jia),對(dui)(dui)造成的(de)環境(jing)污染和(he)生態(tai)破壞(huai)負有(you)責任的(de),除依(yi)照有(you)關法(fa)律法(fa)規規定予以處(chu)(chu)罰(fa)外(wai),還應當(dang)與造成環境(jing)污染和(he)生態(tai)破壞(huai)的(de)其他責任者(zhe)承(cheng)擔連帶責任。對(dui)(dui)不(bu)符合監測(ce)規范、監測(ce)結(jie)果有(you)誤的(de),給予通(tong)報批評,限期整改;對(dui)(dui)于(yu)存(cun)在(zai)弄(nong)虛作(zuo)假(jia)行(xing)為的(de)或(huo)篡(cuan)改偽造監測(ce)數據的(de),依(yi)法(fa)予以處(chu)(chu)罰(fa),并列入黑名單,抄送質量技術監督主管部門;構(gou)(gou)成犯罪的(de),依(yi)法(fa)追(zhui)究刑事責任。
