關于推進環境監測服務社會化的指導意見
各省、自治區、直轄市環境保(bao)護(hu)廳(局(ju)(ju)),新疆生產(chan)建設兵(bing)團環境保(bao)護(hu)局(ju)(ju),解放軍環境保(bao)護(hu)局(ju)(ju),遼河保(bao)護(hu)區管理局(ju)(ju):
為全面深化生(sheng)態文明體制改(gai)革,根據(ju)《環(huan)境(jing)保護法(fa)》和國務院(yuan)辦公廳《關于政(zheng)府向社會(hui)力量購買(mai)服務的(de)指(zhi)導意(yi)見(jian)》(國辦發〔2013〕96號)精神,引導社會(hui)力量廣泛參(can)與環(huan)境(jing)監測(ce),規范社會(hui)環(huan)境(jing)監測(ce)機構(gou)行為,促進環(huan)境(jing)監測(ce)服務社會(hui)化良性發展(zhan),現提出(chu)以(yi)下意(yi)見(jian):
一、充分(fen)認(ren)識推進環(huan)境監測服務(wu)社會化的重(zhong)要意義(yi)
(一)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)測服(fu)(fu)務(wu)(wu)社(she)會(hui)(hui)化(hua)是環(huan)(huan)(huan)(huan)(huan)(huan)(huan)保(bao)體制機(ji)制改革創新的重(zhong)要內容。長期以來,我(wo)國實(shi)行的是由政府(fu)有(you)關部門所屬環(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)測機(ji)構(gou)為(wei)主開展監(jian)(jian)(jian)(jian)(jian)測活動的單一管理(li)(li)體制。在環(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)保(bao)護領域日益擴(kuo)大、環(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)測任務(wu)(wu)快(kuai)速增加和環(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)管理(li)(li)要求不斷提高的情況下,推進環(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)測服(fu)(fu)務(wu)(wu)社(she)會(hui)(hui)化(hua)已迫在眉睫。一些地(di)方已經開展了(le)(le)實(shi)踐探索(suo),出臺了(le)(le)相應的管理(li)(li)辦(ban)法,許多社(she)會(hui)(hui)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)測機(ji)構(gou)已經進入(ru)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)測服(fu)(fu)務(wu)(wu)市場(chang)(chang)。環(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)測服(fu)(fu)務(wu)(wu)的社(she)會(hui)(hui)化(hua)既是加快(kuai)政府(fu)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)保(bao)護職能(neng)轉變(bian)、提高公共服(fu)(fu)務(wu)(wu)質量(liang)和效率的必然要求,也是理(li)(li)順環(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)保(bao)護體制機(ji)制、探索(suo)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)保(bao)護新路的現實(shi)需要。引導社(she)會(hui)(hui)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)測機(ji)構(gou)進入(ru)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)測的主戰場(chang)(chang),提升政府(fu)購買社(she)會(hui)(hui)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)測服(fu)(fu)務(wu)(wu)水平(ping),有(you)利(li)于整合社(she)會(hui)(hui)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)測資源,激發(fa)社(she)會(hui)(hui)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)測機(ji)構(gou)活力,形(xing)成(cheng)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)保(bao)系統環(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)測機(ji)構(gou)和社(she)會(hui)(hui)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)測機(ji)構(gou)共同發(fa)展的新格(ge)局。
二、指導(dao)思(si)想與基(ji)本原則
(二)指(zhi)導(dao)思想。以黨的十八大和(he)十八屆三中(zhong)、四中(zhong)全會精神(shen)為(wei)指(zhi)導(dao),強化政(zheng)(zheng)府環(huan)境監(jian)測(ce)(ce)(ce)公共(gong)服(fu)務職能,加快轉變環(huan)境監(jian)測(ce)(ce)(ce)職能,推進政(zheng)(zheng)事(shi)(shi)分(fen)開和(he)政(zheng)(zheng)社(she)分(fen)開,鼓勵(li)引導(dao)社(she)會環(huan)境監(jian)測(ce)(ce)(ce)力量(liang)廣泛參與,創新環(huan)境監(jian)測(ce)(ce)(ce)公共(gong)服(fu)務供給模式,強化環(huan)境監(jian)測(ce)(ce)(ce)事(shi)(shi)中(zhong)事(shi)(shi)后監(jian)管,形成以環(huan)保系統環(huan)境監(jian)測(ce)(ce)(ce)機構(gou)為(wei)骨干(gan)、社(she)會環(huan)境監(jian)測(ce)(ce)(ce)力量(liang)共(gong)同參與的環(huan)境監(jian)測(ce)(ce)(ce)管理新體制。
(三)基本原則(ze)
——積極引(yin)導(dao)。堅持(chi)從實際(ji)出發,放寬準入條件,充分發揮(hui)政府的主導(dao)作用和(he)市場在資源配置中的決定性作用,激勵社會環境監(jian)測機構提供(gong)監(jian)測服務供(gong)給。
——加快培(pei)育(yu)(yu)。積(ji)極培(pei)育(yu)(yu)環(huan)境(jing)監(jian)測(ce)服(fu)務市(shi)(shi)場(chang),營(ying)造公平(ping)競爭的市(shi)(shi)場(chang)環(huan)境(jing),有序放(fang)開(kai)環(huan)境(jing)監(jian)測(ce)服(fu)務業務領域,推動環(huan)境(jing)監(jian)測(ce)服(fu)務社會化(hua)工作穩步開(kai)展(zhan)。
——規范管(guan)理(li)。建立完(wan)善環境監(jian)測(ce)服務社會化管(guan)理(li)規章制(zhi)度,約束環境監(jian)測(ce)服務行為,促(cu)進社會環境監(jian)測(ce)機構不斷(duan)提(ti)高(gao)環境監(jian)測(ce)質量和管(guan)理(li)水平。
——依法監督。強化環境監測(ce)(ce)行為的(de)事中、事后監管,實(shi)施(shi)對社會環境監測(ce)(ce)機(ji)構及(ji)其(qi)監測(ce)(ce)服務(wu)行為的(de)監督管理,建立正常的(de)退出機(ji)制(zhi),維護環境監測(ce)(ce)服務(wu)市場的(de)正常秩(zhi)序。
三、開放(fang)環境監(jian)測(ce)服務市場
(四)全面放(fang)開服(fu)務(wu)性(xing)(xing)監(jian)(jian)(jian)測(ce)(ce)市場。凡適合(he)社會(hui)力量(liang)承擔的服(fu)務(wu)性(xing)(xing)環境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)業務(wu),要(yao)創造條(tiao)件,全面放(fang)開。鼓(gu)勵社會(hui)環境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)機構參(can)與排(pai)污(wu)單(dan)位污(wu)染源(yuan)自行監(jian)(jian)(jian)測(ce)(ce)、環境(jing)(jing)損害評估監(jian)(jian)(jian)測(ce)(ce)、環境(jing)(jing)影(ying)響評價(jia)現狀(zhuang)監(jian)(jian)(jian)測(ce)(ce)、清潔生產審核、企事(shi)業單(dan)位自主調查等環境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)活動,推(tui)進(jin)環境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)服(fu)務(wu)主體多(duo)元化(hua)和(he)服(fu)務(wu)方(fang)式(shi)多(duo)樣化(hua)。
(五)有(you)序(xu)放開(kai)公益性、監(jian)(jian)督性監(jian)(jian)測(ce)(ce)領域。各級(ji)環(huan)境(jing)(jing)(jing)(jing)(jing)保護行政(zheng)主管(guan)部門所屬環(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)機(ji)(ji)構(gou)應認真做(zuo)好所承擔的(de)政(zheng)府監(jian)(jian)測(ce)(ce)職能(neng),包(bao)括(kuo)(kuo)環(huan)境(jing)(jing)(jing)(jing)(jing)質量監(jian)(jian)測(ce)(ce)、預報預警、跨境(jing)(jing)(jing)(jing)(jing)水體(ti)監(jian)(jian)測(ce)(ce)、履約監(jian)(jian)測(ce)(ce)、污(wu)染源監(jian)(jian)督性監(jian)(jian)測(ce)(ce)、突發(fa)環(huan)境(jing)(jing)(jing)(jing)(jing)事件應急監(jian)(jian)測(ce)(ce),以及環(huan)境(jing)(jing)(jing)(jing)(jing)執法、環(huan)境(jing)(jing)(jing)(jing)(jing)質量目標(biao)責任考核(he)、排污(wu)費征收、總(zong)量核(he)算等環(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)管(guan)中的(de)監(jian)(jian)測(ce)(ce)工作。同(tong)時,可以根據財政(zheng)部、民政(zheng)部和工商總(zong)局(ju)關于政(zheng)府購買(mai)服務的(de)總(zong)體(ti)要求(qiu),將社(she)會環(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)機(ji)(ji)構(gou)能(neng)夠承擔,又(you)不影(ying)響公平公正原則的(de)相關業務,積極穩(wen)妥、因(yin)地制宜地向社(she)會環(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)測(ce)(ce)機(ji)(ji)構(gou)有(you)序(xu)放開(kai),包(bao)括(kuo)(kuo)環(huan)境(jing)(jing)(jing)(jing)(jing)質量自(zi)動(dong)(dong)監(jian)(jian)測(ce)(ce)站和污(wu)染源自(zi)動(dong)(dong)監(jian)(jian)測(ce)(ce)設(she)施的(de)運(yun)行維護、固體(ti)廢(fei)物(wu)(wu)和危險廢(fei)物(wu)(wu)鑒別等監(jian)(jian)(檢)測(ce)(ce)業務。
四、扶(fu)持和(he)規范社會環境監測機構(gou)發展
(六)轉變管理方(fang)式。凡適合社(she)(she)會(hui)(hui)力量承擔的(de),環(huan)境(jing)(jing)保護行政(zheng)主管部(bu)(bu)門(men)(men)均可依據本行政(zheng)區實際,選(xuan)擇采取委托、承包(bao)、采購、名錄管理等方(fang)式交由社(she)(she)會(hui)(hui)力量承擔。同(tong)時,要加強(qiang)對(dui)社(she)(she)會(hui)(hui)環(huan)境(jing)(jing)監測機構事(shi)中(zhong)和事(shi)后監管,會(hui)(hui)同(tong)相關(guan)部(bu)(bu)門(men)(men)共同(tong)出臺(tai)相關(guan)管理政(zheng)策(ce)和辦(ban)法(fa),推動環(huan)境(jing)(jing)監測服(fu)務社(she)(she)會(hui)(hui)化(hua)(hua)(hua)(hua)工作的(de)制度化(hua)(hua)(hua)(hua)、體(ti)系化(hua)(hua)(hua)(hua)、規范化(hua)(hua)(hua)(hua)。
(七(qi))扶(fu)持行業(ye)發(fa)展。要(yao)充(chong)分(fen)發(fa)揮環(huan)境監(jian)(jian)測行業(ye)協會(hui)或第三方機(ji)(ji)構(gou)的作(zuo)用,強化社(she)(she)(she)會(hui)環(huan)境監(jian)(jian)測機(ji)(ji)構(gou)的行業(ye)管理,簽訂質量保(bao)證承諾,推動行業(ye)自律。組織開展社(she)(she)(she)會(hui)環(huan)境監(jian)(jian)測技術人員業(ye)務培訓、業(ye)務比武,評(ping)估社(she)(she)(she)會(hui)環(huan)境監(jian)(jian)測機(ji)(ji)構(gou)的業(ye)務水平,促進環(huan)境監(jian)(jian)測服(fu)務行業(ye)水平的不斷提升。
(八(ba))加強(qiang)誠信建設。社會(hui)環(huan)(huan)(huan)境監(jian)測機(ji)構應對所提供監(jian)測數(shu)據(ju)的(de)(de)真實性和(he)(he)(he)準(zhun)確性負(fu)責(ze),建立(li)健全質量(liang)保證和(he)(he)(he)質量(liang)控(kong)制體系(xi),嚴格執行(xing)國家和(he)(he)(he)地(di)方(fang)的(de)(de)法律法規、標(biao)準(zhun)和(he)(he)(he)技(ji)術規范,規范環(huan)(huan)(huan)境監(jian)測行(xing)為。加強(qiang)技(ji)術人員培訓(xun)(xun),鼓勵監(jian)測技(ji)術人員積極(ji)參加省(sheng)級及以上(shang)環(huan)(huan)(huan)境保護行(xing)政主(zhu)管部(bu)門(men)認可的(de)(de)業(ye)務培訓(xun)(xun)。主(zhu)動(dong)公開信息,自覺接受(shou)社會(hui)公眾(zhong)和(he)(he)(he)環(huan)(huan)(huan)保部(bu)門(men)監(jian)督,提高誠信意識和(he)(he)(he)服務水平。
五、依(yi)法監督環境監測服(fu)務行為
(九(jiu))完善(shan)監(jian)管(guan)機(ji)制。省級環(huan)(huan)(huan)境(jing)(jing)保護(hu)行(xing)政主(zhu)(zhu)管(guan)部門應(ying)完善(shan)日常監(jian)督(du)檢查機(ji)制,加強過程監(jian)管(guan)和信息(xi)公(gong)開(kai),定(ding)期(qi)和不定(ding)期(qi)地(di)檢查社會(hui)環(huan)(huan)(huan)境(jing)(jing)監(jian)測機(ji)構(gou)的監(jian)測質量,公(gong)布(bu)(bu)社會(hui)環(huan)(huan)(huan)境(jing)(jing)監(jian)測機(ji)構(gou)概況和環(huan)(huan)(huan)境(jing)(jing)監(jian)測服務行(xing)為(wei)監(jian)督(du)檢查結果,建(jian)立公(gong)示制度和退出機(ji)制。完善(shan)社會(hui)環(huan)(huan)(huan)境(jing)(jing)監(jian)測服務機(ji)構(gou)信用記(ji)錄,社會(hui)環(huan)(huan)(huan)境(jing)(jing)監(jian)測機(ji)構(gou)及其(qi)法(fa)定(ding)代(dai)表人(ren)在環(huan)(huan)(huan)境(jing)(jing)監(jian)測服務活動中存在不規(gui)范監(jian)測行(xing)為(wei)的,環(huan)(huan)(huan)境(jing)(jing)保護(hu)行(xing)政主(zhu)(zhu)管(guan)部門應(ying)將相應(ying)機(ji)構(gou)、法(fa)人(ren)、監(jian)測技術人(ren)員的違法(fa)信息(xi)記(ji)入(ru)社會(hui)誠(cheng)信檔(dang)案,并及時向社會(hui)公(gong)布(bu)(bu)。
(十)強化(hua)責(ze)任追究。社會環(huan)(huan)境監(jian)測機(ji)構在(zai)有關環(huan)(huan)境服(fu)務活動中弄(nong)虛作假,對造(zao)成(cheng)的環(huan)(huan)境污(wu)染和生態破壞(huai)負(fu)有責(ze)任的,除(chu)依(yi)照有關法(fa)律法(fa)規(gui)規(gui)定予以(yi)(yi)處(chu)罰外,還(huan)應當與造(zao)成(cheng)環(huan)(huan)境污(wu)染和生態破壞(huai)的其他責(ze)任者承擔連帶責(ze)任。對不(bu)符合監(jian)測規(gui)范(fan)、監(jian)測結(jie)果有誤(wu)的,給予通報批評(ping),限期整改;對于存在(zai)弄(nong)虛作假行為的或篡改偽造(zao)監(jian)測數據的,依(yi)法(fa)予以(yi)(yi)處(chu)罰,并列入黑名單(dan),抄送質量技術監(jian)督主管(guan)部門;構成(cheng)犯罪(zui)的,依(yi)法(fa)追究刑(xing)事責(ze)任。
