關于推進環境監測服務社會化的指導意見
各省、自(zi)治區、直轄市環境保(bao)護(hu)(hu)(hu)廳(局(ju)(ju)),新疆生(sheng)產建設兵(bing)團(tuan)環境保(bao)護(hu)(hu)(hu)局(ju)(ju),解放(fang)軍環境保(bao)護(hu)(hu)(hu)局(ju)(ju),遼(liao)河保(bao)護(hu)(hu)(hu)區管理局(ju)(ju):
為(wei)全面深化生(sheng)態文(wen)明體制改革,根據《環(huan)(huan)境保(bao)護法》和國(guo)務(wu)院辦公(gong)廳(ting)《關(guan)于(yu)政府向社(she)會(hui)(hui)力(li)量購買服(fu)務(wu)的指導意見(jian)》(國(guo)辦發(fa)〔2013〕96號)精神,引導社(she)會(hui)(hui)力(li)量廣(guang)泛(fan)參與環(huan)(huan)境監(jian)(jian)(jian)測(ce),規范社(she)會(hui)(hui)環(huan)(huan)境監(jian)(jian)(jian)測(ce)機構行(xing)為(wei),促進環(huan)(huan)境監(jian)(jian)(jian)測(ce)服(fu)務(wu)社(she)會(hui)(hui)化良(liang)性發(fa)展,現(xian)提出以下意見(jian):
一、充分認識推(tui)進環境(jing)監測服務社會(hui)化(hua)的重要意義(yi)
(一(yi))環(huan)(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)測(ce)服(fu)(fu)務(wu)社(she)(she)會(hui)化(hua)是環(huan)(huan)(huan)(huan)(huan)保體(ti)制機制改革創新(xin)的(de)(de)重(zhong)要(yao)(yao)內(nei)容(rong)。長期(qi)以來(lai),我(wo)國實行(xing)的(de)(de)是由政(zheng)府(fu)有(you)關部(bu)門所屬環(huan)(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)測(ce)機構(gou)為(wei)主(zhu)開展(zhan)監(jian)(jian)(jian)測(ce)活動的(de)(de)單(dan)一(yi)管(guan)理體(ti)制。在(zai)環(huan)(huan)(huan)(huan)(huan)境(jing)保護(hu)領(ling)域(yu)日益擴大、環(huan)(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)測(ce)任(ren)務(wu)快(kuai)(kuai)速增(zeng)加(jia)和(he)環(huan)(huan)(huan)(huan)(huan)境(jing)管(guan)理要(yao)(yao)求(qiu)不斷提(ti)(ti)高的(de)(de)情(qing)況下(xia),推進(jin)(jin)環(huan)(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)測(ce)服(fu)(fu)務(wu)社(she)(she)會(hui)化(hua)已迫在(zai)眉睫。一(yi)些地(di)方已經開展(zhan)了實踐探索,出臺了相應的(de)(de)管(guan)理辦法(fa),許多社(she)(she)會(hui)環(huan)(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)測(ce)機構(gou)已經進(jin)(jin)入(ru)環(huan)(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)測(ce)服(fu)(fu)務(wu)市(shi)場。環(huan)(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)測(ce)服(fu)(fu)務(wu)的(de)(de)社(she)(she)會(hui)化(hua)既是加(jia)快(kuai)(kuai)政(zheng)府(fu)環(huan)(huan)(huan)(huan)(huan)境(jing)保護(hu)職能轉變、提(ti)(ti)高公共(gong)服(fu)(fu)務(wu)質量和(he)效率的(de)(de)必然要(yao)(yao)求(qiu),也是理順環(huan)(huan)(huan)(huan)(huan)境(jing)保護(hu)體(ti)制機制、探索環(huan)(huan)(huan)(huan)(huan)境(jing)保護(hu)新(xin)路的(de)(de)現實需要(yao)(yao)。引導社(she)(she)會(hui)環(huan)(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)測(ce)機構(gou)進(jin)(jin)入(ru)環(huan)(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)測(ce)的(de)(de)主(zhu)戰場,提(ti)(ti)升(sheng)政(zheng)府(fu)購買社(she)(she)會(hui)環(huan)(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)測(ce)服(fu)(fu)務(wu)水平,有(you)利于整合社(she)(she)會(hui)環(huan)(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)測(ce)資源,激發社(she)(she)會(hui)環(huan)(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)測(ce)機構(gou)活力(li),形成(cheng)環(huan)(huan)(huan)(huan)(huan)保系統環(huan)(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)測(ce)機構(gou)和(he)社(she)(she)會(hui)環(huan)(huan)(huan)(huan)(huan)境(jing)監(jian)(jian)(jian)測(ce)機構(gou)共(gong)同發展(zhan)的(de)(de)新(xin)格局。
二(er)、指導思想與基本原則
(二)指導思想。以黨的(de)十(shi)八(ba)大(da)和(he)(he)十(shi)八(ba)屆(jie)三(san)中、四中全會(hui)精神為指導,強化(hua)政府環(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)測(ce)(ce)公(gong)共(gong)服務(wu)職能(neng),加(jia)快轉變環(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)測(ce)(ce)職能(neng),推進政事(shi)分(fen)開(kai)(kai)和(he)(he)政社(she)(she)分(fen)開(kai)(kai),鼓(gu)勵引導社(she)(she)會(hui)環(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)測(ce)(ce)力量廣泛參(can)與,創(chuang)新環(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)測(ce)(ce)公(gong)共(gong)服務(wu)供給模(mo)式,強化(hua)環(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)測(ce)(ce)事(shi)中事(shi)后監(jian)管,形成(cheng)以環(huan)(huan)保系統(tong)環(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)測(ce)(ce)機構為骨干、社(she)(she)會(hui)環(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)測(ce)(ce)力量共(gong)同參(can)與的(de)環(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)測(ce)(ce)管理新體(ti)制。
(三(san))基(ji)本原則
——積極(ji)引導(dao)。堅(jian)持(chi)從實際出發,放寬準入條件,充(chong)分發揮政(zheng)府的主導(dao)作用和市場在資(zi)源(yuan)配置(zhi)中的決定性作用,激勵(li)社會(hui)環境監測機構(gou)提供(gong)監測服務供(gong)給。
——加快培育。積(ji)極培育環(huan)境(jing)監(jian)測服務市(shi)場,營造(zao)公(gong)平競爭的(de)市(shi)場環(huan)境(jing),有序放開環(huan)境(jing)監(jian)測服務業務領域,推動環(huan)境(jing)監(jian)測服務社會化工作穩步開展。
——規(gui)范管(guan)理(li)。建立完善環(huan)(huan)境(jing)監(jian)測(ce)服(fu)務社(she)會化(hua)管(guan)理(li)規(gui)章制度,約束環(huan)(huan)境(jing)監(jian)測(ce)服(fu)務行為(wei),促進社(she)會環(huan)(huan)境(jing)監(jian)測(ce)機構不斷提高環(huan)(huan)境(jing)監(jian)測(ce)質量和管(guan)理(li)水平。
——依法監(jian)(jian)督(du)。強化環(huan)境(jing)監(jian)(jian)測(ce)行為(wei)的(de)事(shi)(shi)中、事(shi)(shi)后監(jian)(jian)管(guan),實施對社(she)會環(huan)境(jing)監(jian)(jian)測(ce)機構及其監(jian)(jian)測(ce)服(fu)務(wu)行為(wei)的(de)監(jian)(jian)督(du)管(guan)理(li),建立(li)正(zheng)常(chang)的(de)退(tui)出機制(zhi),維(wei)護環(huan)境(jing)監(jian)(jian)測(ce)服(fu)務(wu)市場(chang)的(de)正(zheng)常(chang)秩序。
三、開放環境監測服務市場
(四)全面放(fang)(fang)開(kai)服(fu)務(wu)性監(jian)測(ce)(ce)(ce)市(shi)場。凡適合社(she)會力(li)量承擔的服(fu)務(wu)性環境(jing)(jing)(jing)(jing)(jing)監(jian)測(ce)(ce)(ce)業務(wu),要(yao)創造條件(jian),全面放(fang)(fang)開(kai)。鼓勵社(she)會環境(jing)(jing)(jing)(jing)(jing)監(jian)測(ce)(ce)(ce)機構參與(yu)排污單位(wei)污染源自(zi)行監(jian)測(ce)(ce)(ce)、環境(jing)(jing)(jing)(jing)(jing)損(sun)害評(ping)估監(jian)測(ce)(ce)(ce)、環境(jing)(jing)(jing)(jing)(jing)影響評(ping)價現(xian)狀監(jian)測(ce)(ce)(ce)、清(qing)潔生產審核、企事(shi)業單位(wei)自(zi)主調(diao)查等環境(jing)(jing)(jing)(jing)(jing)監(jian)測(ce)(ce)(ce)活動,推(tui)進(jin)環境(jing)(jing)(jing)(jing)(jing)監(jian)測(ce)(ce)(ce)服(fu)務(wu)主體多元化和(he)服(fu)務(wu)方式多樣化。
(五)有序放開(kai)(kai)公(gong)(gong)益(yi)性(xing)、監(jian)(jian)(jian)督(du)性(xing)監(jian)(jian)(jian)測(ce)領域。各級環(huan)(huan)境(jing)(jing)(jing)(jing)(jing)保護行政(zheng)(zheng)主(zhu)管部(bu)門所(suo)屬環(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)機構(gou)(gou)應(ying)認真做好(hao)所(suo)承(cheng)擔的(de)(de)(de)(de)政(zheng)(zheng)府監(jian)(jian)(jian)測(ce)職能(neng),包括環(huan)(huan)境(jing)(jing)(jing)(jing)(jing)質量(liang)監(jian)(jian)(jian)測(ce)、預報預警、跨境(jing)(jing)(jing)(jing)(jing)水(shui)體(ti)(ti)監(jian)(jian)(jian)測(ce)、履約監(jian)(jian)(jian)測(ce)、污染源監(jian)(jian)(jian)督(du)性(xing)監(jian)(jian)(jian)測(ce)、突發環(huan)(huan)境(jing)(jing)(jing)(jing)(jing)事件應(ying)急監(jian)(jian)(jian)測(ce),以(yi)及(ji)環(huan)(huan)境(jing)(jing)(jing)(jing)(jing)執法、環(huan)(huan)境(jing)(jing)(jing)(jing)(jing)質量(liang)目標責任考核(he)、排污費征(zheng)收、總量(liang)核(he)算等環(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)管中的(de)(de)(de)(de)監(jian)(jian)(jian)測(ce)工(gong)作。同時(shi),可以(yi)根據財政(zheng)(zheng)部(bu)、民政(zheng)(zheng)部(bu)和(he)工(gong)商總局(ju)關于(yu)政(zheng)(zheng)府購買服務的(de)(de)(de)(de)總體(ti)(ti)要求,將社會(hui)環(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)機構(gou)(gou)能(neng)夠(gou)承(cheng)擔,又不影響公(gong)(gong)平公(gong)(gong)正原(yuan)則的(de)(de)(de)(de)相關業務,積(ji)極穩妥、因地制宜(yi)地向社會(hui)環(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)機構(gou)(gou)有序放開(kai)(kai),包括環(huan)(huan)境(jing)(jing)(jing)(jing)(jing)質量(liang)自動(dong)監(jian)(jian)(jian)測(ce)站(zhan)和(he)污染源自動(dong)監(jian)(jian)(jian)測(ce)設施的(de)(de)(de)(de)運行維(wei)護、固體(ti)(ti)廢物(wu)和(he)危險廢物(wu)鑒別等監(jian)(jian)(jian)(檢)測(ce)業務。
四、扶持和(he)規(gui)范社會環境監測(ce)機構發展
(六)轉變(bian)管理方(fang)式。凡適合社(she)會力(li)(li)量(liang)承擔的,環(huan)境(jing)保護(hu)行(xing)政(zheng)主(zhu)管部門(men)均可依據本行(xing)政(zheng)區(qu)實際,選擇采(cai)(cai)取委托、承包(bao)、采(cai)(cai)購、名錄(lu)管理等方(fang)式交由社(she)會力(li)(li)量(liang)承擔。同(tong)時(shi),要加強(qiang)對社(she)會環(huan)境(jing)監測機構事(shi)中和事(shi)后監管,會同(tong)相(xiang)關部門(men)共同(tong)出臺相(xiang)關管理政(zheng)策和辦(ban)法,推動環(huan)境(jing)監測服(fu)務社(she)會化(hua)工作的制度化(hua)、體(ti)系(xi)化(hua)、規范化(hua)。
(七)扶持行業(ye)(ye)發展。要(yao)充分發揮環境(jing)監(jian)(jian)測行業(ye)(ye)協會或(huo)第三方機構(gou)(gou)的(de)(de)作用,強化社會環境(jing)監(jian)(jian)測機構(gou)(gou)的(de)(de)行業(ye)(ye)管理(li),簽訂質量保證承(cheng)諾(nuo),推動行業(ye)(ye)自(zi)律。組(zu)織(zhi)開展社會環境(jing)監(jian)(jian)測技術(shu)人員業(ye)(ye)務(wu)培訓(xun)、業(ye)(ye)務(wu)比武,評估(gu)社會環境(jing)監(jian)(jian)測機構(gou)(gou)的(de)(de)業(ye)(ye)務(wu)水平(ping)(ping),促進環境(jing)監(jian)(jian)測服務(wu)行業(ye)(ye)水平(ping)(ping)的(de)(de)不斷提升。
(八)加強(qiang)誠信建(jian)設。社會環境(jing)監(jian)測(ce)(ce)機構(gou)應對所提(ti)供監(jian)測(ce)(ce)數據的真實性和準確性負責,建(jian)立健(jian)全質(zhi)量保(bao)證(zheng)和質(zhi)量控制(zhi)體系(xi),嚴(yan)格執(zhi)行(xing)(xing)國(guo)家和地方的法律法規、標準和技術(shu)規范,規范環境(jing)監(jian)測(ce)(ce)行(xing)(xing)為。加強(qiang)技術(shu)人員培訓,鼓勵監(jian)測(ce)(ce)技術(shu)人員積極參加省級及以(yi)上(shang)環境(jing)保(bao)護行(xing)(xing)政主管部門認可的業務培訓。主動公(gong)開(kai)信息,自覺接受(shou)社會公(gong)眾和環保(bao)部門監(jian)督,提(ti)高誠信意識(shi)和服務水(shui)平。
五、依(yi)法監(jian)(jian)督環境監(jian)(jian)測服務行為
(九)完(wan)(wan)善監(jian)(jian)(jian)(jian)管機(ji)(ji)制。省級環境(jing)(jing)(jing)保護行政主(zhu)管部(bu)門(men)應(ying)完(wan)(wan)善日常(chang)監(jian)(jian)(jian)(jian)督檢查(cha)機(ji)(ji)制,加(jia)強過程監(jian)(jian)(jian)(jian)管和(he)信(xin)息公開,定期和(he)不定期地檢查(cha)社會(hui)環境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)機(ji)(ji)構(gou)(gou)的(de)(de)(de)監(jian)(jian)(jian)(jian)測(ce)(ce)質量,公布社會(hui)環境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)機(ji)(ji)構(gou)(gou)概況和(he)環境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)服務行為監(jian)(jian)(jian)(jian)督檢查(cha)結果,建立(li)公示(shi)制度和(he)退出(chu)機(ji)(ji)制。完(wan)(wan)善社會(hui)環境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)服務機(ji)(ji)構(gou)(gou)信(xin)用記錄,社會(hui)環境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)機(ji)(ji)構(gou)(gou)及其(qi)法定代表人在環境(jing)(jing)(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)服務活動(dong)中存(cun)在不規(gui)范監(jian)(jian)(jian)(jian)測(ce)(ce)行為的(de)(de)(de),環境(jing)(jing)(jing)保護行政主(zhu)管部(bu)門(men)應(ying)將相應(ying)機(ji)(ji)構(gou)(gou)、法人、監(jian)(jian)(jian)(jian)測(ce)(ce)技術人員的(de)(de)(de)違法信(xin)息記入(ru)社會(hui)誠信(xin)檔案,并及時向(xiang)社會(hui)公布。
(十(shi))強化(hua)責(ze)(ze)(ze)任(ren)(ren)追(zhui)(zhui)究。社(she)會環境監(jian)(jian)測(ce)(ce)機構(gou)在(zai)有(you)關環境服務活動中弄虛作假,對造(zao)(zao)成(cheng)(cheng)的環境污(wu)染和(he)生(sheng)態(tai)破壞負有(you)責(ze)(ze)(ze)任(ren)(ren)的,除(chu)依照有(you)關法律(lv)法規(gui)規(gui)定(ding)予(yu)以處罰(fa)(fa)外,還應當與(yu)造(zao)(zao)成(cheng)(cheng)環境污(wu)染和(he)生(sheng)態(tai)破壞的其(qi)他責(ze)(ze)(ze)任(ren)(ren)者承擔連帶責(ze)(ze)(ze)任(ren)(ren)。對不符(fu)合監(jian)(jian)測(ce)(ce)規(gui)范、監(jian)(jian)測(ce)(ce)結果有(you)誤的,給予(yu)通報批評,限期整改(gai);對于(yu)存在(zai)弄虛作假行為的或篡改(gai)偽造(zao)(zao)監(jian)(jian)測(ce)(ce)數(shu)據的,依法予(yu)以處罰(fa)(fa),并列(lie)入黑名單(dan),抄送質量技術監(jian)(jian)督主管部門;構(gou)成(cheng)(cheng)犯罪(zui)的,依法追(zhui)(zhui)究刑(xing)事責(ze)(ze)(ze)任(ren)(ren)。
